5 Reasons to use a Family Lawyer

What’s the difference between a good lawyer and a bad lawyer? A bad lawyer might let a case drag on for several years. A good lawyer knows how to make it last even longer.

 

Unfortunately I don’t find this funny, simply because I know a number of lawyers that are just like this! However, there are valid reasons why you should still strongly consider using a lawyer, even if you have come to an agreement yourself with your ex-partner. 

 

1.They know the law

As you may have discovered already, Family Law is a unique area of law. Having a clear understanding of the rights, entitlements and obligations of each partner arising in your unique circumstances can make a major difference to the agreement reached. A lawyer can also let you know what is possible, and not possible, in relation to dividing your assets, deciding on parenting arrangements or agreeing to a child support agreement. You can not find every answer via Google. Also without legal advice, you risk misunderstanding your obligations or circumstances which could prove damaging to your outcome. 

2. They can easily navigate the Court

Not only are lawyers able to speak for you before a judge in a courtroom, they know how the processes and procedures work. Again, even if you have reached an agreement, to formalise this agreement you will need to file Consent Orders with the court. The documents you file with the court need to be legally correct and filed correctly, otherwise you risk having to re-do various things numerous times, or risk simply having your matter dismissed. In the long run, a family lawyer could save you time, money and a lot of stress. 

3. Alternative dispute resolution

Lawyers don’t just know how to go to court. They are also experienced negotiators. Processes such as formal mediation, collaborative law and the ability to negotiate matters directly with another lawyer, can actually save you time and money whilst at the same time ensure that you are achieving the best outcome possible in your circumstances. 

4. Reduce stress

Separation is one of the most emotional and stressful processes you will go through. Additional stress is created by not knowing what to do or where to go and having to discuss a settlement with your ex-partner who in many cases, is the last person you want to communicate with. An experienced family lawyer will be able to navigate the process for you, provide you with options and outcomes, and also if needed, be a ‘buffer’ between you and your ex when you can’t (or don’t want to!) communicate directly with them. 

5. Emotional support

Yes! Lawyers are human too (well some of us!) and we can provide the ear you need and the moral support required to make sure you get through the separation process so that you can move on with your life. Trust me, we have seen it all before and I guarantee your case will not be the worst we have navigated our way through. Sometimes just knowing that you are not alone, your situation is ‘normal’ in the world of family law, and others in your shoes have gone onto greener pastures, can be one of the most helpful aspects of having a family lawyer. 

 

Given all of this, perhaps the most important thing then is choosing the right family lawyer for you. My advice in relation to this is to speak with the family lawyer, make sure they are experienced, and most importantly make sure you like them as a person!
